Terms of Service

Welcome to TruckerPro. These Terms of Service ("Terms") govern your access to and use of our website at truckerpro.ca, the TruckerPro Fleet mobile application for iOS, the TruckerPro Driver mobile application for iOS and Android, and all related services (collectively, the "Services"). By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use our Services.
1. Eligibility & Acceptance
By using our Services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal authority to enter into these Terms (or are authorized by your employer to use the Services on their behalf)
- If creating a company account, you have the authority to bind that company to these Terms
- All information you provide is accurate, current, and complete
2. Description of Services
TruckerPro provides transportation management software for trucking companies, dispatchers, and commercial drivers operating in Canada and the United States. Our Services include:
Web Platform (truckerpro.ca)
- Fleet and dispatch management (load creation, assignment, tracking)
- Driver compliance tracking (license status, medical certificates, endorsements)
- Criminal record check processing through accredited third-party providers
- Human resources management (employee records, onboarding, policy management)
- Billing and subscription management
- Team management and role-based access control
- Maintenance and bodyshop work order management
- Driver settlement and financial tools
TruckerPro Fleet App (iOS)
- Mobile dispatch management for fleet managers and dispatchers
- In-app voice calling to drivers
- Real-time messaging with drivers
- Load and driver status monitoring
- Push notifications for dispatch events
TruckerPro Driver App (iOS & Android)
- Load viewing, status updates, and delivery tracking
- Document scanning and upload (BOL, POD, receipts, inspection reports)
- GPS-stamped checkpoints and delivery confirmations
- Messaging with dispatchers and fleet managers
- Trip tools (kingpin-to-tandem calculator, axle weight calculator)
- LCV (Long Combination Vehicle) equipment management
- Push notifications for dispatch assignments and messages
3. User Accounts & Security
To access our Services, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security and confidentiality of your login credentials
- Complete two-factor authentication when prompted
- Notify us immediately at [email protected] of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
4. Subscriptions & Licensing
Company Subscriptions
Company accounts provide access to the TruckerPro web platform and associated tools. Subscription plans, pricing, and included features are as quoted at the time of sign-up or as subsequently agreed. Company subscriptions include access to the TruckerPro Fleet mobile app for authorized dispatchers and fleet managers.
Driver App — Company-Assigned Licenses
Fleet managers and dispatchers may assign TruckerPro Driver app licenses to their drivers through the web platform at no additional cost to the driver. These licenses remain active as long as:
- The assigning company maintains an active TruckerPro subscription
- The driver remains associated with the company's account
Companies may revoke driver licenses at any time. Revocation immediately terminates the driver's access to the app.
Driver App — Individual Subscriptions
Independent drivers (owner-operators) not affiliated with a TruckerPro company account may subscribe individually at $5.00 CAD per month. New individual accounts receive a 30-day free trial with full feature access. After the trial period, an active paid subscription is required to continue using the app.
No Digital Content Purchases
The TruckerPro Driver and Fleet applications do not offer any digital content, consumable items, or in-app purchases for consumption. Subscriptions provide access to fleet management tools only.
5. Payment Terms
- All fees are quoted and charged in Canadian Dollars (CAD)
- Payments are processed securely by Stripe, a PCI-DSS compliant payment processor
- Subscription fees are billed monthly in advance on the same day each month
- By providing a payment method, you authorize us to charge the applicable fees to your card
- Failed payments may result in service suspension after a reasonable grace period and notification
- Applicable taxes (GST/HST, sales tax) will be added to your invoice as required by law
6. Background Check Services
By using our criminal record check services, you acknowledge and agree that:
- You are requesting the check for yourself, or you have obtained proper written authorization from the individual being checked
- All information provided for the check is accurate and truthful
- Background checks are conducted by accredited third-party providers accessing the RCMP CPIC database — TruckerPro does not conduct checks directly
- Results are provided for informational purposes and are valid for one (1) year from the date of completion
- Background check fees are non-refundable once a check has been submitted to the third-party provider
- You will use background check results in compliance with all applicable federal and provincial/state human rights and employment laws
7. Communication Services
Our Services include communication features for operational purposes:
In-App Messaging
Messaging between drivers, dispatchers, and fleet managers is provided for business and operational use related to dispatch, load management, and fleet operations. Messages are stored on our servers and accessible to the sending and receiving parties, as well as authorized company administrators.
Voice Calling (Fleet App)
The TruckerPro Fleet app provides in-app voice calling capability for dispatchers to communicate with drivers. By using this feature:
- You consent to the transmission of your voice data through our communication service provider
- Calls are facilitated through a third-party telephony provider and are subject to their service availability
- Call metadata (time, duration, participants) may be logged for operational purposes
- TruckerPro does not record call audio content
SMS Notifications
We may send SMS messages to your registered phone number for two-factor authentication codes, critical dispatch notifications, and account security alerts. Standard messaging rates from your carrier may apply. You may opt out of non-essential SMS notifications by contacting support.
8. Acceptable Use Policy
You agree not to use our Services to:
- Violate any applicable federal, provincial, state, or local law or regulation
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems
- Interfere with or disrupt the operation of the Services or the servers and networks connected to them
- Send unsolicited messages, spam, or harassing content through our messaging features
- Use voice calling features for purposes unrelated to fleet operations
- Upload malicious files, viruses, or harmful content
- Reverse engineer, decompile, or disassemble any part of the Services
- Resell, sublicense, or redistribute access to the Services without written authorization
- Use the Services in any manner that discriminates against individuals based on protected characteristics
Violation of this policy may result in immediate suspension or termination of your account.
9. Data Processing for Company Accounts
When a company uses TruckerPro to manage fleet operations:
- The company is the data controller — responsible for determining the purposes and means of processing driver and employee data
- TruckerPro is the data processor — we process data on the company's behalf according to the functionality of the Services and these Terms
As a company using TruckerPro, you are responsible for:
- Obtaining appropriate consent from your drivers and employees for data collection and processing through our Services
- Complying with all applicable privacy and employment laws in the jurisdictions where you operate
- Ensuring that HR data (including Social Insurance Numbers and employment records) is collected and processed lawfully
- Responding to privacy requests from your drivers and employees regarding data you control
TruckerPro will assist companies in responding to data subject requests to the extent reasonably possible, as described in our Privacy Policy.
10. Intellectual Property
All content, features, functionality, software, designs, and branding of the TruckerPro Services are owned by TruckerPro and are protected by Canadian and international copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose during your active subscription. You may not copy, modify, distribute, sell, or create derivative works based on our Services without prior written permission.
Content you upload (documents, photos, load data) remains your property. By uploading content, you grant TruckerPro a limited license to store, process, and display that content as necessary to provide the Services.
11. Third-Party Services
Our Services integrate with and rely upon third-party service providers for payment processing, communication, cloud infrastructure, and other functions. Your use of these integrated services is subject to their respective terms and privacy policies.
TruckerPro is not responsible for the availability, accuracy, or content of third-party services. We select providers with appropriate security and privacy standards, but we cannot guarantee their performance.
Certain features (such as voice calling and SMS) depend on third-party provider availability and may be subject to temporary outages beyond our control.
12. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free
- Results obtained from the Services will be accurate or reliable
- Background check results are complete, current, or error-free (results are provided by third-party providers)
- Trip calculation tools (kingpin-to-tandem, axle weight calculators) produce results that comply with current regulations in all jurisdictions — always verify with your local DOT/MTO
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUCKERPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO TRUCKERPRO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless TruckerPro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Services in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party rights
- Any content or data you submit through the Services
- Your use of background check results in violation of applicable human rights or employment laws
15. Dispute Resolution & Governing Law
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to conflict-of-law principles.
Informal Resolution
Before initiating any formal dispute proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Canadian Users
Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of the Province of Manitoba, Canada.
United States Users
For users located in the United States, any disputes that cannot be resolved informally shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall be conducted in English. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against TruckerPro.
16. Refund Policy
- Background checks: Non-refundable once submitted to the third-party provider
- Subscriptions: Contact [email protected] within 7 days of a billing charge for refund consideration
- Service failures: Full refund provided if we are unable to deliver a service due to our own technical failure
- Free trials: No charge is incurred during the trial period. If you cancel before the trial ends, you will not be charged
17. Account Deletion
You may request deletion of your account at any time by contacting [email protected] with the subject line "Account Deletion Request". Account deletion will:
- Cancel any active subscriptions immediately
- Revoke access to all TruckerPro apps and the web platform
- Delete your personal data in accordance with our Privacy Policy
Certain records may be retained as required by applicable tax, employment, or regulatory laws. See our Privacy Policy -- Data Retention for details.
If your account was created by your employer (company-assigned license), contact your employer to request removal.
18. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if:
- You violate these Terms or our Acceptable Use Policy
- Your payment method fails and remains unresolved after reasonable notice
- We are required to do so by law or court order
- We reasonably believe your account poses a security risk
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) will remain in effect.
19. Changes to Terms
We may modify these Terms at any time. When we make material changes:
- We will update the "Last Updated" date at the top of this page
- For significant changes, we will notify registered users via email or in-app notification at least 15 days before the changes take effect
- Continued use of the Services after the effective date constitutes acceptance of the updated Terms
- If you do not agree with the updated Terms, you must stop using the Services and may request account deletion
