Canada's ELD mandate has been in full effect since January 1, 2023. Every federally regulated commercial motor vehicle that requires a driver to maintain a record of duty status must use a certified electronic logging device. No more paper logs, no more grandfathering — compliance is mandatory.
Who Must Use an ELD?
The mandate applies to all drivers of commercial motor vehicles that: - Operate under federal jurisdiction (inter-provincial or international) - Are required to keep a daily log under the Commercial Vehicle Drivers Hours of Service Regulations
This includes most tractor-trailers, straight trucks over 4,500 kg, and buses operating across provincial or international borders.
Exemptions
You do NOT need an ELD if: - You operate within a single province (provincial rules apply) - You operate within a 160 km radius of your home terminal - Your vehicle was manufactured before the year 2000 - You are a permitted carrier operating under a short-term permit (up to 30 days) - You drive a vehicle that doesn't have an engine ECM (electronic control module)
Note: Even exempt drivers must still comply with HOS regulations using paper logs or time records.
Certified ELD Requirements
Transport Canada maintains an official list of certified ELDs. A certified device must:
- Automatically record engine hours, vehicle miles, date/time, and location
- Synchronize with the engine ECM — no manual mileage entry
- Display records to enforcement officers on demand
- Transfer data via USB, Bluetooth, or email
- Prevent tampering — data edits must be logged and visible
- Record all duty status changes — driving, on-duty not driving, sleeper berth, off-duty
- Include driver annotations for edits
- Meet the technical standard specified in the ELD Technical Standard published by Transport Canada
Choosing an ELD Provider
Key Factors to Consider
| Factor | Why It Matters |
|---|---|
| Transport Canada certified | Non-certified devices = non-compliant |
| FMCSA registered (if cross-border) | US operations require separate FMCSA registration |
| Integration with your TMS | Avoid duplicate data entry |
| GPS tracking included | Most modern ELDs include this |
| Driver app quality | Drivers use it daily — it needs to be intuitive |
| Customer support | Issues at 2 AM on the highway need fast resolution |
| Monthly cost | $15–$40/month per vehicle is typical |
Choosing an ELD Provider in Canada
Transport Canada maintains the certified-device list. Pick a device that is both Transport-Canada certified and FMCSA-registered if you cross the border, fits your fleet size and language needs, and exposes an API your TMS can integrate with.
Enforcement and Penalties
What Happens During an Inspection?
Officers will ask to see your ELD display. They can review: - Current day's logs - Previous 14 days of records (US: 8 days) - Unassigned driving events - Driver edits and annotations
Penalties for Non-Compliance
| Violation | Consequence |
|---|---|
| No ELD installed | Out-of-service order + fine ($250–$500) |
| ELD malfunction (not reported) | Out-of-service + fine |
| Tampering with ELD | Out-of-service + potential criminal charges |
| Using non-certified device | Same as no ELD |
| HOS violation detected via ELD | Fine + CSA points |
ELD Malfunction Rules
If your ELD malfunctions: 1. Note the malfunction in your daily log 2. Report to your carrier within 24 hours 3. Reconstruct logs on paper for that day 4. Carrier must fix or replace within 14 days (Canada) or 8 days (US) 5. Carry a paper log book as backup until resolved
