Speed Limiter Mandate for Trucks: Where It Stands Heading Into 2027

Few proposed regulations have divided the trucking industry as sharply as the speed limiter mandate. First introduced over a decade ago, the rule requiring electronic speed limiters on heavy commercial vehicles has been through cycles of proposals, public comment periods, political delays, and revivals. As the industry heads into 2027, the mandate is closer to becoming enforceable federal law than it has ever been. Here is where things stand, what the rule would actually require, and how carriers on both sides of the border should be preparing.

A Long Road: The Rulemaking History

The push for mandatory speed limiters on commercial trucks dates back to 2006, when the American Trucking Associations (ATA) petitioned the National Highway Traffic Safety Administration (NHTSA) to require speed-governing devices on heavy trucks. A formal Notice of Proposed Rulemaking (NPRM) was issued jointly by NHTSA and the FMCSA in September 2016, marking the first concrete regulatory step.

That 2016 proposal drew over 4,900 public comments, revealing a deeply divided industry. The rule languished through the final years of the Obama administration and was effectively shelved during the Trump administration, which deprioritized it. In 2022, the FMCSA revived the effort by issuing a Supplemental Notice of Proposed Rulemaking (SNPRM), reopening the public comment period and introducing updated analysis on safety, fuel economy, and emissions benefits. The comment period drew another wave of industry feedback, and the rule has been working its way through the regulatory pipeline since.

As of early 2026, the FMCSA has signaled that a final rule could be published in late 2026 or early 2027, with a compliance deadline following 12 to 24 months after publication. Nothing is guaranteed in federal rulemaking, but the momentum is real.

What the Proposed Rule Would Require

The FMCSA's proposal centers on three speed thresholds that have been under consideration throughout the rulemaking process:

  • 60 mph — The most restrictive option, favored by safety advocacy groups. This would match the governed speed many large carriers already use.
  • 65 mph — A middle-ground option that aligns with the speed cap already in place at several of the largest US fleets, including Werner, J.B. Hunt, and Schneider.
  • 68 mph — The least restrictive option, which still sits below the 70 to 75 mph posted speed limits on many US interstates.

The final rule is expected to settle on a single maximum governed speed, with most industry observers expecting 65 or 68 mph based on the direction of the FMCSA's supplemental analysis.

Which Trucks Would Be Affected

The rule would apply to Class 7 and Class 8 commercial motor vehicles — those with a gross vehicle weight rating (GVWR) of 26,001 pounds or more. This covers the vast majority of tractor-trailers, heavy straight trucks, and vocational vehicles operating on US highways.

Critically, the rule targets trucks manufactured with an engine control module (ECM) capable of setting a maximum speed. In practice, this covers nearly every heavy truck built since the late 1990s, as ECMs have been standard equipment for decades. Older trucks without ECM capability would likely be exempt, though they represent a small and shrinking share of the active fleet.

The mandate would apply to all covered vehicles operating on US roadways, regardless of where the truck is registered. Canadian and Mexican carriers crossing the border would need to comply.

The Industry Split

The speed limiter debate exposes one of trucking's sharpest fault lines: the divide between large carriers and owner-operators.

Large carriers largely support the mandate. Many of the biggest US fleets already govern their trucks at 62 to 65 mph voluntarily. For them, a federal mandate levels the playing field, preventing smaller competitors from running faster and potentially undercutting them on transit times. The ATA has been a consistent advocate, arguing that speed limiters reduce crash severity, lower fuel costs, and improve insurance outcomes.

Owner-operators and small carriers strongly oppose it. Organizations like the Owner-Operator Independent Drivers Association (OOIDA) have fought the rule at every stage, arguing that it creates dangerous speed differentials on highways where passenger vehicles travel at 70 to 80 mph. Their core safety argument is straightforward: a truck governed at 65 mph merging into traffic moving at 75 mph creates the kind of speed differential that causes accidents, particularly during passing maneuvers and highway on-ramps. OOIDA also frames the issue as one of economic freedom, noting that slower trucks mean longer transit times and reduced earning potential for owner-operators paid by the mile.

There is legitimate safety research supporting both positions. The debate is not as simple as either side presents it.

The Safety Data

Speed is a persistent factor in fatal crashes involving commercial motor vehicles. According to FMCSA data, speed-related factors contribute to roughly 7 to 8 percent of fatal crashes involving large trucks each year. NHTSA's broader crash data shows that higher speeds increase both the likelihood and severity of crashes across all vehicle types.

Proponents of the mandate point to studies estimating that a 68 mph limiter could prevent between 63 and 214 fatalities annually, depending on the speed threshold chosen. Opponents counter that these estimates do not adequately account for the speed differential effect — the increased risk created when trucks travel significantly slower than surrounding traffic. A 2012 study published in the Accident Analysis & Prevention journal found that crash rates increase when the speed variance between vehicles on the same roadway grows, a finding that OOIDA has cited extensively.

Both sides cite data selectively, and the full picture is more nuanced than either camp acknowledges.

Canada's Approach: Ontario as the Test Case

Canada offers something the US debate often lacks: real-world data from an existing speed limiter mandate. Ontario introduced mandatory speed limiters for heavy commercial vehicles in 2009, requiring trucks to be governed at a maximum of 105 km/h (approximately 65 mph). Quebec followed with a similar requirement.

Ontario's experience has been mixed. Studies commissioned by the Ontario Ministry of Transportation found modest reductions in speed-related collisions involving heavy trucks on provincial highways. However, enforcement has been a challenge, and the trucking community in Ontario has raised many of the same speed differential concerns voiced by US opponents. Some drivers report that the 105 km/h cap creates frustration on Highway 401, where passenger vehicle speeds often exceed 120 km/h.

For Canadian carriers already operating under Ontario or Quebec speed limiter rules, a US federal mandate at 65 or 68 mph would require minimal adjustment. Their trucks are already governed at or near the expected US threshold.

The Fuel Savings Argument

One of the strongest and least contested arguments for speed limiters is fuel economy. Aerodynamic drag increases with the square of velocity, meaning each additional mile per hour above 55 mph produces a disproportionate increase in fuel consumption.

Industry estimates consistently show that reducing cruising speed by 1 mph saves approximately 2 to 4 percent in fuel consumption, depending on the vehicle, load, terrain, and conditions. For a truck consuming 20,000 gallons of diesel annually, governing from 75 mph down to 65 mph could save 2,000 to 4,000 gallons per year. At current diesel prices, that translates to meaningful per-truck savings.

Large fleets have cited fuel economy as a primary reason for voluntarily governing their trucks, sometimes even more than safety. The emissions reduction co-benefit also aligns with EPA goals and state-level clean air mandates.

Enforcement: How It Would Work

The proposed rule relies on engine control module (ECM) verification rather than roadside speed measurement. During Level I and Level II inspections, enforcement officers would access the truck's ECM data to verify that the governed speed is set at or below the mandated maximum.

This approach has several advantages over trying to catch speeding trucks in real time. ECM data is tamper-evident, and modern diagnostic tools can read the governed speed setting in minutes. Carriers found to have tampered with or disabled the speed limiter would face violations, fines, and potentially out-of-service orders.

The enforcement mechanism mirrors how Ontario verifies compliance with its 105 km/h rule: inspectors check the ECM during roadside inspections and at inspection stations. The FMCSA has indicated that CVSA-trained inspectors would be equipped to perform these checks as part of their existing inspection protocols.

What Carriers Should Prepare For

Whether the final rule arrives in late 2026 or slips into 2027, carriers should be positioning themselves now rather than waiting for a compliance scramble.

  • Audit your current fleet speed settings. Know the governed speed on every truck in your fleet. If you are already running at 65 mph or below, you are likely ahead of the curve.
  • Evaluate the financial impact. For carriers currently running at 70+ mph, model the impact on transit times, driver pay (particularly for mileage-based compensation), and fuel costs. The fuel savings may partially or fully offset the productivity impact.
  • Train your drivers. Speed limiters change driving behavior, particularly on hills and during passing maneuvers. Drivers need to understand how to operate safely within a governed speed environment.
  • Watch the rulemaking calendar. The FMCSA's Unified Agenda of Regulatory and Deregulatory Actions is updated twice yearly and provides the most reliable signal on timing. Monitor it or use a compliance service that tracks regulatory changes.
  • If you run cross-border, check both jurisdictions. Canadian carriers already complying with Ontario or Quebec rules are well positioned. US carriers who enter Canada should be aware that provincial rules may differ from the eventual federal US standard.

The Bottom Line

The speed limiter mandate has been one of trucking's longest-running regulatory debates, and it appears to be nearing a conclusion. The final rule will not satisfy everyone. Large carriers will see validation of practices they adopted years ago. Owner-operators will see another constraint on their independence and earning potential. The safety data supports reasonable arguments on both sides.

What is not debatable is the need to be ready. The carriers who prepare now — adjusting fleet settings, modeling financial impacts, and training drivers — will handle the transition smoothly. Those caught flat-footed will face compressed timelines, compliance costs, and unnecessary operational disruption.
